General terms and conditions

The following general terms and conditions (GTC) also contain legal information on your rights under the provisions on contracts in distance selling and electronic business transactions.

 

  1. Scope

These general terms and conditions (GTC) apply to all deliveries by DESSAIVE Selected Interior Design and Accessories to consumers (§ 13 BGB).

A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.

 

  1. Contractual partner

The purchase contract is concluded with DESSAIVE Selected Interior Design and Accessories, owner Susanne Dessaive, Am Hainberg 1, 61462 Königstein im Taunus, U-St-Id.-Nr. DE 111 49 79 23.

  1. Offer and conclusion of contract

3.1 The presentation of the products in the online shop is not a legally binding offer, but an invitation to order. Errors excepted.

3.2 By clicking the ‘Buy now’ button, you are placing a binding order for the goods listed in the shopping cart. The purchase contract is concluded when we accept your order by sending an order confirmation by email immediately after receiving your order.

 

  1. Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.

In order to exercise your right of cancellation, you must inform us of your decision to cancel this contract by means of a clear declaration (e.g. an email or a letter sent by post). You can use the cancellation form attached below, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.

The right of revocation does not apply to distance sales contracts – for the delivery of goods that are not prefabricated and for whose manufacture an individual selection or determination by the consumer is decisive or that are clearly tailored to the personal needs of the consumer.

Consequences of the withdrawal

If you withdraw from this contract, we will have given you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have) to repay immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment.

 

The following applies to freight forwarded goods

We pick up the goods when they have been delivered by a logistics company. You bear the direct costs of returning the goods.

The following applies to goods that can be sent by parcel

We can refuse repayment until we have received the goods back or until you have provided evidence that you have sent back the goods, whichever is earlier.

 

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you informed us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods.

 

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods.

  1. Prices and shipping costs

5.1 The prices stated on the product pages include the statutory value added tax and other price components.

5.2 Information on additional shipping costs can be found under the menu item Shipping.

 

  1. Delivery

6.1 Delivery takes place within Germany with various transport service providers. You can find an overview under the menu item Shipping.

6.2 Information on delivery times can be found on the respective product page.

6.3 Deliveries within Europe or to the USA and Canada must be requested individually at the moment. For this purpose, we have created a table on the product page, in which you can conveniently enter your data that is required to determine the freight or delivery costs. We will determine the costs for you and inform you as soon as possible so that you have a basis for deciding whether you want to buy.

 

  1. Payment

Payment can be made either by ‘bank transfer’, ‘PayPal’ (with all its payment options, without you having to have a PayPal account) and ‘prepayment’, which can be selected during the ordering process. A detailed overview of the payment methods and possible credit cards can be found in the footer (on the website at the bottom right) under Payment Options.

Once you have selected the product you want, you can place it in the shopping cart without obligation by clicking the ‘Add to cart’ button. You can view the contents of the shopping cart at any time without obligation by clicking the cart symbol. You can remove the products from the shopping cart at any time by clicking the cross (symbol of an X). After removing a product, please click on ‘Update cart’.

If you want to buy the products in the shopping cart, click either the button ‘Proceed to checkout’ or ‘PayPal’, ‘SEPA direct debit’ or ‘Debit or credit card’ to speed up the payment process. In all three cases you will be redirected to an offer from PayPal that you can use without having to maintain an account on PayPal.

If you select ‘Proceed to checkout’, please enter your ‘Billing details” and, if applicable, delivery address (if this should differ). Here you can also order our newsletter, which will introduce you to new products in the range or offers once a week.

The mandatory information is marked with a red *. Registration is not required. Your data will be transmitted in encrypted form. After entering your data, you can click on the ‘Continue with step 2’ button to go to the ‘Choose a Payment Gateway’ page. Here you can choose between ‘Bank Transfer’, ‘PayPal’ (with all its payment options) and ‘Payment in advance’. Then click on the button ‘Continue with step 3’ and go to the ‘Your order’ page. Please check here your shopping cart, billing address and delivery address again. You can correct any of the points listed at any time. Please confirm the terms and conditions, the revocation provisions and the data protection provisions and, if you like, also whether you would like to receive an evaluation email after 7 days.

By clicking on the ‘Buy now’ button, you complete the payment order process. The process can be canceled at any time by clicking on the DESSAIVE logo, by clicking on the ‘Back to Step 2’ button or by closing the browser window. You will find further information on the individual pages, e.g. about correction options or missing information.

 

Contract text

The text of the contract is saved on our internal systems. You can view the general terms and conditions at any time on this page. If you have created a customer account, you can view your customer data at any time under ‘My Account’ (top right). The order details will be sent to you by email. After completing the order, the text of the contract can no longer be accessed via the Internet for security reasons.

 

Alternative dispute resolution in accordance with Art. 14 Paragraph 1 ODR-VO and § 36 VSBG:

The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
